Court Awards GH¢100k Against Anas For Trespassing
An Accra High Court Court has ordered Anas Aremeyaw Anas, to pay damages of GH¢60,000 to a businessman for trespassing on his land.
Anas has also been ordered to pay a legal cost of GH¢40,000 to the businessman after the court presided over by Justice Kwame Gyamfi Osei, found that a disputed land which was the subject matter of a court case belonged to the businessman and not the award-winning journalist.
Adolf Tetteh Adjei, in a suit, had alleged that Anas was trespassing on his land and was developing it with the assistance of the police and land guards.
The suit alleged that Anas had erected a signpost which read “Tiger Eye Property. Keep Off” on the about two-acre land located within East La Dadekotopon area.
The plaintiff was seeking among others, an order declaring the land as his, damages for trespassing and possession of the land.
He also sought an order against Anas, his assigns and agents to stay away from the disputed land and disturbing his peaceful occupation and possession of the land.
Anas, in a counterclaim, averred that the said land belonged to him and the sale of the land to the plaintiff was tainted with fraud.
Justice Osei, at the end of the trial, found that the land in question belonged to the businessman and not Anas Aremeyaw Anas.
The court said although Anas mounted a signpost on the land which read “Tiger Eye Property. Keep Off”, he opposed an application which sought to join Tiger Eye to the suit, by claiming that Tiger Eye had no interest in the said land.
The court subsequently granted all of the plaintiff’s relief and awarded GH¢60,000 as damages and another GH¢40,000 as legal costs against Anas.
The court also perpetually restrained Anas, “his servants, agents, assigns, workmen and all those claiming through him from entering, carrying out any construction work or interfering with that piece or parcel of land… in any manner whatsoever or disturbing the plaintiff’s peaceful occupation and possession of same.”
“I dismiss the entire counterclaim of 1st Defendant (Anas),” Justice Osei added.
