Akosua Serwaa Fosu, wife of Ghanaian highlife legend Daddy Lumba, has taken legal action to stop funeral plans she says were made without her knowledge or consent.
Court documents filed by her legal team at Dominion Chambers reveal that Akosua Serwaa is seeking an interlocutory injunction to halt all preparations for the late musician’s burial, arguing that she was excluded from the decision-making process.
Her lawyers described the public announcement of the funeral date as “deeply distressing,” explaining that the family learned about it only through social media rather than any official communication.
The documents accuse Abusuapanyin Kofi Owusu, the head of Daddy Lumba’s family, and a self-appointed funeral committee of fixing the funeral for December 6, 2025, without consulting the singer’s legally wedded wife.
“PRAYING this Honourable Court for an Order restraining the Defendants, their agents, assigns, workmen, etc., from either collecting the body of the late CHARLES KWADWO FOSU a.k.a. DADDY LUMBA from the morgue and performing the burial and final funeral rites of the deceased, upon the grounds set out in the accompanying Affidavit,” the writ stated.
In a separate statement, members of the musician’s “direct family” confirmed that legal measures were underway to suspend the funeral until proper discussions were held. They alleged that since Daddy Lumba’s death on July 26, 2025, there had been a “continuous and deliberate effort to marginalise” his wife in all matters concerning the funeral.
The statement added that the cause of the singer’s death is still being investigated.
It also reminded the public that Daddy Lumba was legally married to Akosua Serwaa on December 23, 2004, in Bornheim, Germany, where bigamy is prohibited by law.
Quoting Section 1306 of the German Civil Code (Bürgerliches Gesetzbuch), the family noted:
“A marriage may not be entered into if one of the persons is already married,” adding that any subsequent union under such circumstances is “legally void.”
The family stressed that the legal action was meant to avoid confusion and ensure that the late musician receives a dignified burial conducted in line with both legal and cultural expectations.
“To all Lumba fans and music lovers across the world, we deeply appreciate your love, loyalty, and patience during this difficult time. We kindly ask you to disregard any unofficial announcements regarding funeral arrangements,” the statement read.
It concluded with an assurance that a “respectful and dignified farewell” will be held to celebrate Daddy Lumba’s life, legacy, and immense contribution to Ghanaian music.
