Akosua Serwaa has intensified her court fight over her status as the wife of the late highlife legend Daddy Lumba, filing an appeal to overturn a Kumasi High Court ruling that rejected the marriage certificate she presented in support of her claim.
The appeal, lodged on December 1, 2025, challenges a decision delivered on November 28 by Justice Dorinda Smith Arthur. Akosua Serwaa argues that the judgment was wrongly decided and should be reversed by the Court of Appeal.
According to documents accompanying the appeal, her grievance centers on the trial court’s refusal to place evidential weight on the marriage certificate she tendered during proceedings.
“Please take notice that the Plaintiff/Appellant herein being aggrieved and dissatisfied with the Judgment of the High Court, Kumasi more particularly stated herein and contained in the Judgment of His Ladyship Justice Dorinda Smith Arthur sitting at the High Court, Kumasi and dated on the 28th day of November, 2025 do hereby appeal to the Court of Appeal against the decision upon the grounds set out in paragraph 3 and will at the hearing of the appeal seek the reliefs set out in paragraph 4,” part of the suit reads.
In setting out her grounds, Akosua Serwaa contends that the High Court erred in law by declaring the marriage certificate inadmissible and by relying heavily on provisions of the Evidence Act in reaching that conclusion. She also disputes the court’s assessment of credibility, arguing that her evidence was unfairly discounted in favour of that presented by the defendants.
“The High Court erred when it held that the Marriage Certificate exhibit ‘B’, ‘B1’ and ‘B2’ was not admissible per se. The Court erred when it held that Section 161 of the Evidence Act is a condition precedent for putting weight on an admitted document. The Court erred when it held that the evidence adduced by the defendants was more credible than that of the evidence of the complainant,” another part of the suit stated.
Her lawyer, William Kusi, is asking the appellate court to overturn the ruling in its entirety and enter judgment in her favour.
“That the whole judgment of the High Court be set aside and judgment entered in favour of the Plaintiff,” it added.
The High Court decision under appeal recognised both Akosua Serwaa and Priscilla Ofori, popularly known as Odo Broni, as surviving wives of Daddy Lumba.
In the original case, Akosua Serwaa had asked the court to declare her the sole surviving spouse with exclusive widowhood rights. She also sought an order preventing Odo Broni from holding herself out as Daddy Lumba’s wife or being acknowledged as such by the head of the Ekuona family.
The court rejected those claims, ruling that Akosua Serwaa had not discharged the burden of proof required to establish her case. Central to that finding was her failure to produce original copies of her marriage certificate.
Justice Dorinda Smith Arthur held that the documents tendered “fell short of Sections 136 and 161,” explaining that the law required the original certificate from the Bornheim Marriage Registry, along with proper certification from the Ghana Embassy in Germany. What was submitted, the court noted, amounted only to an extract.
