A legal battle over an alleged debt has taken another turn after the Commercial Division of the High Court in Accra authorised UK-based Cola Holdings Limited to take possession of the No. 1 Oxford Street Hotel in Osu, a property linked to Ghanaian businessman Nana Kwame Bediako, popularly known as Cheddar.
The ruling, according to a Graphic Online report, stems from a dispute involving Kensington Residential Partners 1 Limited, where Bediako serves as a director. Cola Holdings is seeking to enforce a security interest over the property as part of efforts to recover an outstanding debt it claims is owed.
In a decision delivered on July 21, 2026, Justice Samuel Faraday Johnson granted a warrant of police assistance, allowing Cola Holdings and its appointed Receiver in Ghana, Nii Amanor Dodoo, to take possession of the prominent white hotel building situated near Dankwa Circle in Osu.
The court acted on an application filed by Cola Holdings and the Receiver after they informed the court that attempts to gain possession of the property without confrontation had failed.
Court documents show that Kensington Residential Partners 1 Limited, through one of its directors, Nana Kwame Bediako, also known as Cheddar, challenged the application. However, the court rejected the objections raised.
In its ruling, the court held that Cola Holdings had properly registered its security interest over the property at the Collateral Registry and had secured a Memorandum of No Objection authorising it to proceed with enforcing that security.
Justice Faraday Johnson further ruled that under the Borrowers and Lenders Act, 2020 (Act 1052), the lender was entitled to seek police assistance after it was unable to obtain possession of the property without resistance.
The court also concluded that Kensington Residential Partners 1 Limited had failed to present sufficient evidence to justify refusing the application.
As a result, the court authorised the issuance of a warrant of police assistance to enable Cola Holdings and the Receiver to take possession of the hotel and realise the security in accordance with the law.
Court records identify Tsatsu Tsikata and Tata Kosi Foliba as counsel for Cola Holdings and the Receiver, while Bobby Banson and Isaac Akerefie-Mensah represented Kensington Residential Partners 1 Limited.
The judge made it clear that the order deals only with the Receiver’s request for police assistance and does not resolve any other legal issues or claims that remain in dispute between the parties.
The latest decision is one of several developments in an ongoing legal contest over the enforcement of a security interest tied to the No. 1 Oxford Street Hotel.
Court filings indicate that Nii Amanor Dodoo was appointed Receiver by Cola Holdings under the Borrowers and Lenders Act after the company initiated steps to enforce its security over the property.
The dispute is linked to earlier proceedings concerning the enforcement in Ghana of a judgment issued by the High Court of England and Wales in favour of Cola Holdings Limited.
In January 2026, Bediako, also known as Freedom Jacob Caesar, publicly maintained that he disputed liability under the foreign judgment and had instructed his lawyers to challenge its enforcement before the Ghanaian courts.
The businessman, who contested Ghana’s 2024 presidential election as an independent candidate, said the transaction arose from a financing facility that Kensington Residential Partners 1 Limited had obtained from the International Finance Corporation.
He also disclosed that he had appealed an earlier High Court decision relating to the registration of the foreign judgment and intended to pursue every legal avenue available to contest the matter.
The latest ruling does not address those pending appeals or determine the substantive dispute between the parties. It is limited to granting the Receiver police assistance to take possession of the property while the broader legal proceedings continue.
